The Ministry of Labour and Employment has decided the rules sectioned under the four labour codes carving the route towards making the reforms a reality by notifying these for implementation at the earliest.
The four broad codes pertaining to wages, industrial relations, social security along with occupational safety, health, and working conditions (OSH) have priorly been intimated post acquiring the President’s assent. However, for enforcing the four codes, the rules are supposed to be notified.
Currently, the ministry has concluded the consultation process over draft rules structured with four codes and firmed up those for notification.
While addressing the issue to PTI news agency, Labour Secretary Apurva Chandra said, “We have finalised the rules under the four codes which are required to implement the four labour codes. We are ready to notify these rules. The states are doing their work to firm up rules under the four codes.”
The Parliament has processed four codes over four broad codes pertaining to wages, industrial relations, social security, and occupational safety health & working conditions which would ultimately rationalize 44 central labour laws.
In 2019, the Codes on wages were passed by the Parliament, whereas the additional three other codes got clearance from both the Houses in the year 2020.
The ministry proposes to have the implementation of all the four codes at once. After solidifying the the rules, the four codes can be notified all at once.
On February 8, 2021, Chandra had stated in a press conference, “Rule-making process is already underway and likely to be completed in the coming week. All stakeholders are also consulted in the framing of rules. This ministry would soon be in a position to bring into force the four Codes, viz., Code on Wages, Industrial Relations, Occupational Safety, Health and Working Conditions (OSH) and Social Security Codes.” As labour is a concurrent subject, certain rules would also be formulated by the states sectioned under the four codes. The states are also on the way of notifying the draft rules and holding tripartite consultations to solidify for implementation
